NJSC Naftogaz of Ukraine intends to deliver 264 million cubic meters of gas to Moldova and European Union countries on March 3, the company's press service reports.

"It is important that both Russian Federation and Ukraine reaffirm their respective positions of a reliable supplier and transit country of gas, as was the case over the past years", the EC said.

On Wednesday, Stockton Arbitration ordered Gazprom to pay 2.56 billion United States dollars under the transit contract with Naftogaz Ukraine, but the company disagreed with the court decision and announced its intention to "protect its rights in line with the legislation it adopted".

Gazprom was quoted by TASS as saying in a statement: "Earlier, the same arbiters agreed with Naftogaz's explanations that the decline in the demand for gas and Naftogaz's non-compliance with its gas purchase commitments were caused by a slump in the Ukrainian economy".

The court had previously delivered a separate verdict in the dispute over gas supplies between Gazprom and Naftogaz. "This will improve security of supply and give Ukrainians affordable energy". The decision seriously violates the balance of interests of the parties under these contracts.

Gazprom and Naftogaz signed the current contract for the supply of gas to Ukraine in January 2009 and it is valid until December 31, 2019.

Due to an emergency gas shortage, Ukraine's power plants must now use oil instead of gas. At the same time, however, the arbitrators retained the "take-or-pay" condition for 4 billion cubic meters of gas per year and obliged the Ukrainian company to pay $ 2-billion debt for gas and set a penalty for non-payment, which by now is more than $40 million. Naftogaz demanded that Gazprom should pay $17bn for the failure to supply the agreed volumes for transit. The Stockholm court ruled that Gazprom should pay only $4.7bn to Naftogas.

Naftogaz said Friday that Gazprom had not only refused to resume deliveries meant for it, but lowered the pressure in gas pipelines by 20 percent and minimised sales to other customers.
