"However, the High Court found that before using the track, the Party took extensive advice and sought assurances from industry professionals that the track could be used by the Party".

The National Party's 2014 election ads were broadcast more than a hundred times before they were replaced.

Attorney Garry Williams, representing Eminem, noted that the rapper rarely licensed the song and that it is a "jewel in the crown of Eminem's catalogue". "The undeniable inference to be drawn from the evidence is that the composer of "Eminem Esque" had "Lose Yourself" in front of him at the time of composition", it added.

National Party President Peter Goodfellow said in a statement he was disappointed with the ruling.

National said it believed it had purchased the music, titled Eminem Esque, legally as it came from a reputable Australia-based music production library. It was calculated and intentional.
