Sigmar Gabriel said Wednesday the European Court of Justice's ruling confirms that the solidarity approved by EU leaders is not just in keeping with European values but also adheres fully to European law. Only around 24,000 people have been relocated so far.

The European Court of Justice has dismissed actions brought by Slovakia and Hungary against a provisional mechanism for the mandatory relocation of asylum seekers. "We protect Hungary from the invasion of migrants, but we provide help for genuine refugees, those whose lives are in direct danger on account of their religion, nationality, or political affiliation", Sejmen said, adding that Christians can easily integrate into the Christian European civilization, unlike Muslims, who refuse to do so.

In July, the EU Commission threatened the Czech Republic, Hungary and Poland with lawsuits for not implementing the relocation measures. Under the plan, Hungary would have temporarily taken in 1,294 asylum-seekers and Slovakia 902, the Associated Press (AP) newswire reported.

"Our position on quotas does not change", Fico said.

Greece's asylum service faces a huge workload due to the increase of applications from refugees and migrants over the past year.

If the member states do not change their approach in the coming weeks, we should then consider [taking] the last step in the infringement procedure: "to refer Poland, Hungary, and the Czech Republic to the European Court of Justice".

She said that "leaders such as (Hungarian Prime Minister) Viktor Orban can not demand more money for border protection, while blocking the reception of refugees from Greece and Italy".

The European Council's decision in September 2015 provided for 120,000 people "in clear need of global protection" to be relocated from Italy and Greece to other EU member states. Slovakia and Hungary denounced the plan at the time, citing their heterogeneous population, with a largely single ethnic representation, as an extra burden in resettling refugees.

'This decision practically and openly legitimates the power of the European Union above the member states'.

The program is considered a key part of the EU's migration policy.

Why didn't Hungary and Slovakia want to take in the asylum seekers?

The ECJ claims that the European Union is entitled to making such exceptions in the legislative process, saying that the quotas help relieve the considerable pressure on the asylum systems of Italy and Greece.
